In recent times, a number of significant developments have occurred in competition law in Pakistan, including the establishment of the Acquisitions & Mergers Facilitation Office within the Competition Commission of Pakistan, amendments to the merger control regulations and a number of notable decisions by the Competition Commission of Pakistan. In a decision dated 6 May 2009, the Fair Trade Commission determined that the adverse consequences of restraining competition arising from the proposed acquisition of more than 34% of the issued shares of Tang-Eng Iron Works Co., Ltd. by Yieh United Steel Corporation would outweigh the overall economic benefit from the transaction, and hence the FTC prohibited the proposed merger.

The Government of India pursuant to its notification(s) dated 15th May 2009 has brought into force Sections 3 and 4 of the Competition Act. The Competition Commission of India (the “CCI”) will be operational from May 20, 2009.
