The Competition Commission of Singapore has imposed fines totalling S$1.69 million on 16 coach operators and their trade association, the Express Bus Agencies Association, for engaging in price fixing of coach tickets. This decision was reached almost five months after the CCS issued its proposed infringement decision to the parties in June 2009.
The JFTC issued surcharge payment orders to foreign manufactures for the first time in history. In the marine hose international cartel case, the JFTC issued cease and desist orders to foreign manufacturers in the first time; however, the JFTC could not issue surcharge payment orders because foreign manufactures had no marine hose sales in Japan. In this CRT the JFTC found that CRT manufacturers and their Southeast Asian manufacturing subsidiaries or affiliates had participated in price-fixing conspiracy and thereby had substantially restrained competition in the field of CRT sales in Japan.

Following the notification of s.66 of the Indian Competition Act 2002 (the “Act”) on September 1, 2009 repealing the MRTP Act and providing for a 2 year sunset period, the President of India passed an Ordinance calling for the immediate dissolution of the MRTP Commission and the transfer of all pending cases with effect from October 14, 2009.

The sun is about to set on the Monopolies and Restrictive Trade Practices Act, 1969 (the MRTP Act) as section 66 of the Competition Act, 2002 and section 50 of the Competition (Amendment) Act, 2007 are brought into force. Pursuant to a notification of the Ministry of Corporate Affairs, as from 1 September 2009, the MRTP Act shall stand repealed and the provisions relating to the transition and eventual transfer of cases pending before the Monopolies and Restrictive Trade Practices Commission (the MRTP Commission) will come into force.
