    Taiwan Fair Trade Commission Imposes Sanctions on Cable Television Companies for Violation of Pre-Merger Filing

    In a decision dated 7 July 2009, the Fair Trade Commission determined that Dafeng TV Ltd. and DigiTai TV Ltd., two cable television companies operating in Banciao, Taipei County, had violated the Fair Trade Act due to failure to make a pre-combination notification to the FTC for their regular joint operations through a joint venture company. Consequently, the FTC ordered the two companies to take proper corrective actions within three months, and imposed a fine of NT$2 million on each company.

    The Taiwan Fair Trade Commission Blocks Merger of Stainless Steel Enterprises

    In a decision dated 6 May 2009, the Fair Trade Commission determined that the adverse consequences of restraining competition arising from the proposed acquisition of more than 34% of the issued shares of Tang-Eng Iron Works Co., Ltd. by Yieh United Steel Corporation would outweigh the overall economic benefit from the transaction, and hence the FTC prohibited the proposed merger.

    The Taiwan Fair Trade Commission Blocks KTV Merger for Third Time

    Cashbox Party World Karaoke Parlors ("Partyworld") and Holiday Group Co. Ltd. ("Holiday") are the largest and second-largest enterprises in the multimedia karaoke parlor market in Taiwan. In a decision dated 15 April 2009, the Taiwan Fair Trade Commission ("TFTC") determined that the potential adverse consequences of stifled competition arising from the proposed acquisition and merger of Partyworld by Holiday would outweigh the overall economic benefit from the transaction. This is the third time that the TFTC blocked the proposed merger.
